Sign the original in front of the required witnesses or notary.

Attestation, for example at the Embassy of India, Doha, so Indian courts accept it.

Mutual consent divorce: what to expect

If you and your spouse agree, the process is usually the shortest route. These are the stages.

Stage 1

Settlement terms

Alimony, custody and belongings agreed in writing before anything is filed.

Stage 2

First motion

The joint petition is filed and statements are recorded. Video appearance may be allowed.

Stage 3

Waiting period

Usually about six months between the two motions. A court may waive it in suitable cases.

Stage 4

Second motion and decree

The court hears both of you again and, if satisfied, passes the decree.

Timelines depend on the court and on your facts. We give you a realistic view at the first consultation.

If a case has been filed against you in India

A 498A, domestic violence or maintenance case can reach you in Qatar long before you plan a trip home. A few things matter early.

Do not ignore a summons or notice

Replying on time protects your position and avoids further orders being passed in your absence.

Check before you book a flight

If a criminal case is pending, speak to us first so we can check for a Look Out Circular and any protection available.

Do not sign what you have not understood

Settlement papers, affidavits and undertakings can have long-term effects. Have them reviewed first.

Keep your records safe

Messages, bank transfers, travel history and photographs can all matter later. Do not delete them.

Questions NRIs in Qatar ask

Can I file for divorce in India while I live in Qatar?

Yes. A petition can usually be filed where you married, where your spouse lives, or where you last lived together in India. We confirm the right court for your facts.

Do I have to travel to India?

Often not for routine dates. Courts can allow video appearance in suitable cases, and a Power of Attorney holder can handle many steps. Some stages may still need you in person — we tell you upfront.

Is a divorce granted outside India valid here?

Not automatically. Indian courts may refuse to recognise a foreign decree that isn’t based on grounds available under Indian law. Get advice before filing abroad.

A 498A case was filed. Can I still travel?

It depends on the stage of the case and any orders passed. Speak to us before you book a flight to India so we can check for Look Out Circulars and seek protection where appropriate.

How long does a mutual consent divorce take?

There is usually a gap of about six months between the first and second motions, which a court may waive in suitable cases. The total time depends on the court and on how ready your documents are.

Can I give evidence or appear from Qatar?

Courts may allow appearance or evidence by video conference in suitable cases, subject to the court’s permission and local procedure. We tell you early which stages may need you in person.

Can custody be decided if my child lives outside India?

Custody and visitation depend on the child’s welfare and the facts of the case. We advise on arrangements that work across Qatar and India, including regular video contact.

What is a Look Out Circular (LOC)?

It is a request to immigration authorities in India to monitor, and in some cases stop, a person leaving the country. If a criminal case such as 498A is pending, it is wise to check your position before booking travel.

Do I need to visit your chamber in Delhi?

Not for the first discussion — that happens by video call or WhatsApp. Some stages of a case may need you in person, and we tell you upfront.

Will anyone in Qatar, including my employer, be told?
